Subject: Important Reminder: Maintaining Clear Easements on Your Property

Dear Peninsula Homeowners,

As we head into the warmer months, the Architectural Review Committee wants to send a friendly but important reminder about the proper care of easements on your lots. These areas are critical for utility access, proper drainage, flood prevention, and the overall safety and appearance of our community.

Please ensure the following:

  • All easements (including utility easements, drainage easements, and any common area easements shown on the Subdivision Plat) must remain completely clear of brush, overgrown vegetation, debris, structures, storage items, or any other materials that could impede access, maintenance, or the natural flow of water.
  • No dumping of brush, mowed grass clippings, yard waste, leaves, limbs, trash, or any other refuse is permitted in any easement or drainage area at any time.

These requirements are clearly stated in our Declaration of Covenants, Conditions and Restrictions (the “Declaration”):

  • Article 5.1 (Platted Easements) and Article 5.5 (Drainage Easements) prohibit placing or allowing any material, planting, or debris in easements that could damage utilities, interfere with maintenance, or alter water flow. Owners are responsible for continuous maintenance of these areas on their lots.
  • The Design Guidelines (incorporated into the Declaration) further emphasize that every lot has a 10-foot side-lot utility/drainage easement (per General Note 2 on the Plat, Slide B-23), and no owner may perform any act that would divert, increase, accelerate, or impede natural drainage.
  • Article 8.8 (Garbage and Refuse Disposal) specifically forbids dumping refuse on any drainage area.

Keeping these areas clear protects your property, helps prevent flooding or erosion issues, ensures utility companies and emergency services have unobstructed access, and preserves the beauty and value of our neighborhood.
